ODR Framework & Rules

Legal Framework and Statutes

  1. In India, ODR is recognized under the Arbitration and Conciliation Act, 1996, Consumer Protection Act, 2019, Information Technology Act, 2000, and Indian Evidence Act, 1872.
  2. Electronic records and digital signatures receive legal status, and online agreements and proceedings are admissible.
  3. SEBI and other regulators provide codes of conduct and standards for arbitrators, conciliators, and ODR institutions, emphasizing independence, impartiality, ethics, and confidentiality

Platform and Procedural Rules

  1. Most platforms follow a tiered process: pre-conciliation, followed by conciliation, and lastly arbitration if required.
  2. The process usually starts with complaint registration, assignment to a case manager, pre-conciliation (21 days), and escalates to conciliation and then arbitration if unresolved.
  3. Arbitrators and conciliators must follow strict codes of conduct, including adherence to ethical standards and avoiding conflicts of interest

Advocate. Poonam Yadav

Advocate Poonam Yadav, enrolled with the Bar Council of India and Goa, holds M.Com and LL.B degrees. As Assistant Manager at Alexa Partners, she brings experience in managing a wide range of legal matters. She leads the firm’s litigation portfolio, handling commercial disputes, Debt Recovery Tribunal (DRT) matters, civil suits, mediation proceedings, settlement agreements, Lok Adalat cases, and cases under Section 138 of the Negotiable Instruments Act. She also possesses sound knowledge of the SARFAESI Act, Family Court Matters and is well-versed with the entire process of case filing. Having appeared before and visited various courts across Mumbai, she has gained comprehensive practical exposure to court procedures. In addition to litigation, she is actively involved in key non-litigation work, including drafting and reviewing Master Service Agreements (MSAs) and Non-Disclosure Agreements (NDAs) service Agreement, legal Notices and Reply of Legal notices. And have experienced in handling civil, criminal, and corporate matters. She has worked on cheque dishonour cases under Section 138 of the Negotiable Instruments Act, recovery suits under the CPC, Family Court Matters, arbitration, and RERA and Debt Recovery Tribunal (DRT), SARFAESI Act, Lok Adalat cases proceedings. Her work also includes drafting and reviewing legal documents such as MOUs, sale deeds, consent terms, and contractual agreements. Currently, she is associated with Alexa Partners, where she manages cheque dishonour and recovery cases for financial institutions. Aishwarya is known for her strong legal drafting, research, and case management skills, ensuring effective and result-oriented dispute resolution.
