Filing and Registration of a Case

  • Receipt of a Case: The Online Court receives a case from the Claimant. This can be a new claim.
  • Online Claim Receipt: The claim is received through the Online Court platform.
  • Verification and Case Number Assignment: Upon receiving a claim, the Registrar verifies the details and documents. If everything is in order, the Registrar assigns a unique case number in the following format:

Schedulling First Meeting

Scheduling the First Hearing: After assigning a case number, the Registrar schedules the first hearing, considering the availability of the mediator/conciliator and the advocates involved.

  • Issuance of Notice: Once a case number is assigned, the Registrar prepares a notice to be sent to the opposite party. The team verifies the notice before it is issued.
  • Methods of Issuance: The Registrar issues the notice through the following methods:

  • Follow-up Communication: A dedicated person follows up with the opposite party after the notice is issued to inform them about the scheduled hearing and encourage

  • Hearing Notification: On the day of the hearing, all parties are informed about the hearing and provided with the necessary link to join.
  • Timely Commencement: The Registrar ensures that the hearing starts precisely at the scheduled time.
  • Preparation for Hearing: The Claimant's representative must be fully prepared with all relevant details and documents pertaining to the case.
  • Hearing Commencement Procedure: At the beginning of the hearing, the Registrar announces the case number and the names of the parties involved.
  • Recording of Hearings: All Online Court hearings are recorded, and both parties are informed about the recording.
  • Scheduling Subsequent Hearings: At the end of the hearing, any next date agreed upon by the mediator and the parties is recorded by the Registrar in the case file.

  • Minutes of Meeting (MOM): After the hearing, the Registrar drafts the minutes of the meeting, which are then verified by the Online Court team.
  • Distribution of MOM: The finalized MOM is shared with both the Claimant and the Opposite Party via email.
  • Follow-up for Next Hearing: For any subsequent hearings, follow-up communication occurs as follows:
  • First follow-up: After issuing the MOM.
  • Second follow-up: After confirming receipt of the MOM.
  • Third follow-up: On the day of the hearing.
  • Non-Starter Report: If the hearing concludes without any further dates being scheduled, the Registrar prepares a Non-Starter Report.
  • Verification of Non-Starter Report: The Online Court team verifies the Non-Starter Report.
  • Content of Non-Starter Report: The Non-Starter Report includes:

ODR Settlement

  • Confirmation of Understanding: If the parties reach a settlement agreement, the Opposite Party must confirm their understanding via email or other suitable means.
  • Settlement Agreement Drafting: The Online Court drafts a formal settlement agreement based on the agreed terms.
  • Execution of Agreement: The Claimant and the Opposite Party execute the settlement agreement.
  • Closure of Case: The Registrar shares the executed settlement agreement with both parties and closes the case.
